How to refuse the minimum wage and pay less

Any employer has the right to refuse the application of the minimum wage in Moscow from July 1, 2017. Note that in 2017 the Federal Tax Service continues the practice of salary commissions. Moreover, the IFTS has the right to transfer to labor inspectorates information about employers who pay low wages (letter dated April 21, 2017 No. ED-4-15/7708).

The purpose of the salary commissions is to identify the "gray" salary and personal income tax debts. An employer may be invited to a salary commission:

  • due to personal income tax debts;
  • if personal income tax payments have decreased by 10 percent or more;
  • if the salary is below the regional subsistence minimum, the minimum wage or the industry average.
