What is taken into account when calculating

Such a value as the subsistence minimum is subject to constant change due to inflationary processes in the national economy. With the increase in prices for basic products, the need for funds for life support increases among citizens.

The cost of living is considered as the total cost of obligatory payments and goods in the consumer basket. To simplify the calculation system, the total cost of living is calculated. And for each social group, its size separately.

  • it forms budget expenditures for the next year.

But each region of the country has its own peculiarities. Therefore, the regional authorities are endowed with such powers and the right to adjust the amount of the subsistence minimum at their discretion. It helps assess living standards, draw up local budgets, and provide assistance to families.

Amount for a family of 4

The calculation will be made after citizens submit a special application to the department of social protection.

In order to correctly make all the calculations, the social worker must know the full composition of the family, as well as the income of each working adult in this family for the last three months.

Information is also needed regarding the property owned by this family.

The family may include:

  • married citizens living with minor children;
  • citizens living in a civil marriage, living with minor children;
  • guardians living together and their wards;
  • blood relatives living together.

As a basis for calculations, all incomes determined by law can be taken.

This may include all types of remuneration, including the average income that must be retained by the employee in cases of temporary disability, dismissal, or other situations specified in the Labor Code.

This list includes social benefits for citizens, pensions, as well as the following benefits:

  • unemployment;
  • pregnancy;
  • childbirth;
  • for children under 1.5 years old.
  • compensation for the fulfillment of labor obligations
  • severance pay.

This list should include alimony, disability payments due to injuries or occupational diseases.

If a citizen receives income from the rental of real estate, received an inheritance, income from entrepreneurship, creativity, or there is a bank account in his name, then such income should also be taken into account.

At the same time, there are some categories of income that cannot be taken into account in the calculations:

  • income of adult children, if they live separately from their parents;

  • spouse's income if he is serving a sentence in places of detention.

Formula

All calculations are based on the following formula:

Average per capita income (DA) = income of all seven members (D) / 3 (calculation period is 3 months) / Number of people (NC).

Each region has its own subsistence level. This figure is recalculated quarterly. In the third quarter of last year, it amounted to 10,328 rubles.

To calculate assistance, the cost of living is taken and multiplied by 1.5. This is necessary to determine the maximum amount of family income.

If the calculation result is less than the established minimum multiplied by 1.5, then the family can count on receiving assistance.

Calculation samples

Example 1

Let's make a calculation for a family of four, which includes two adults and two children. The income of the spouse is 60 thousand rubles. The wife's income is 40 thousand people.

It turns out that the family income is 100 thousand rubles.

We make calculations:
SD \u003d 100,000/3/4 \u003d 8,333 rubles.

We consider the limit size: 10328 * 1.5 = 15 492. It turns out that the calculated amount is lower than the limit size.

Example 2

Let's try to make calculations for a family that consists of two spouses, one minor child and a pensioner. Husband earns 60 thousand, wife 30 thousand. The pension is 20 thousand.

As we have already calculated, the maximum size is 15,492. The result of the calculations is also lower than this indicator, which means that the family can count on state support.

Example 3

Calculation for a family of four, which includes two spouses, one minor child and one adult child who has been a disabled person of the second group since childhood and lives with his parents.

The spouse earns 50,000, the wife 40,000, the allowance for disabled people from childhood of the second group is 10,068.53 rubles.

SD \u003d 100,068/3/4 \u003d 8,339 rubles.

This figure is also lower than 15,492 rubles. This family may also be eligible for benefits.

Who can apply for low income status

Citizens receive the status of a low-income family after recognition of this by local governments. When making a decision, their income per family member is taken into account.

This status gives the right to receive benefits from the state. Features of assistance depend on the region in which the family lives.

The main condition for obtaining such a status is the calculation of the average per capita income. And on the basis of the resulting amount, a decision is made.

When assigning such a status to a family, it is important to remember that a family is a group of citizens who have a common way of life, that is, they live together. Usually these people are connected by family ties. But there are exceptions.

Determine the amount of the benefit

Risks for Moscow employers

If the Moscow salary for July, August or September 2017 is lower than the minimum wage, then the employer may be held administratively and criminally liable. A fine in the amount of 1,000 to 5,000 rubles can be imposed on an individual entrepreneur or director of an organization, and from 30,000 to 50,000 rubles on an organization. For a repeated violation, directors can be fined from 10,000 to 20,000 rubles. or be disqualified for a period of one to three years. Director's responsibility

An employee whose salary was less than the minimum wage has the right to demand an additional payment for the entire period of work and compensation for the delay (Article 236 of the Labor Code of the Russian Federation). For the payment of wages below the minimum wage for more than two months, the head of the organization is subject to criminal liability (parts 2 and 3 of article 145.1 of the Criminal Code of the Russian Federation).

How to refuse the minimum wage and pay less

Any employer has the right to refuse the application of the minimum wage in Moscow from July 1, 2017. To do this, it is required to draw up and send a reasoned refusal to the local branch of the Committee on Labor and Employment. The term is 30 calendar days from the date of publication of the tripartite agreement on the regional minimum wage (Article 133.1 of the Labor Code of the Russian Federation).

In this case, the refusal must be motivated. This means that the employer needs to be informed of the reasons why the employer cannot pay his employees the regional "minimum wage" - 17,642 rubles. As such reasons, one can indicate, for example, “crisis”, “few orders”, “risk of mass dismissal of employees”, and so on. However, please note that clause 8 of Article 133.1 of the Labor Code of the Russian Federation obliges the employer to attach a set of documents to the refusal, among which are proposals on the timing of raising the minimum wage of employees to the amount stipulated by the agreement. That is, even a timely refusal does not mean that you will not have to pay the new minimum wage, established from July 1, 2017, at all. The employer simply has the right to delay its introduction.

Article 133.1 of the Labor Code of the Russian Federation gives the Moscow authorities the right to invite representatives of an employer who has refused to accept a new minimum wage from July 1, 2017, for consultations.   • if personal income tax payments have decreased by 10 percent or more;
