As explained in the press service, from October 17 to 27, on the regional Internet portal “Dobrodel”, on behalf of the Governor of the Moscow Region Andrei Vorobyov, the Ministry of Housing and Communal Services of the Moscow Region organized a popular Internet vote of residents for the inclusion of courtyard areas in 2018. On Tuesday, a briefing on the voting results was held at the regional Government House.

“Such voting is the government’s absolute guarantee to residents that their wishes regarding the improvement of their yards will be fulfilled in full. This know-how of digital voting in housing and communal services allows people to be socially in demand and take an active civic position, because the voice of each resident will be taken into account when forming a targeted program and will not allow some municipal officials to, as they say, “wash out” addresses and follow the line of least resistance when financing the improvement of courtyard areas,” said Evgeny Khromushin, Minister of Housing and Communal Services of the Moscow Region, at a briefing, as quoted by the press service.

According to the press service, thanks to a massive information campaign in the media, social networks, and at meetings of owners, people took part in the voting.

“Residents cast their votes for 3,968 households out of 8,098 that were publicly displayed. The address list of courtyard areas planned for comprehensive improvement in 2018 included 1,461 courtyard areas; it was formed from two sources. The first part included 673 courtyards based on voting results, the other part included 788 courtyard territories included on behalf of the President of the Russian Federation and the Governor of the Moscow Region, as well as on the basis of citizens’ appeals to local governments, on the recommendation of the State Technical Supervision Authority of the Moscow Region, taking into account the opinion of the Association chairmen of the councils of apartment buildings in the Moscow region,” said Evgeny Khromushin.

According to him, the statistics of voters are completely relevant, since all voting participants confirmed their identity using a unified identification and authentication system (USIA). It is noteworthy that almost half of all voters (11 thousand people) supported the idea of ​​personal labor participation in the improvement of their yard.

As the press service clarified, the residents of Balashikha showed the greatest activity in voting - 2848 votes, Domodedovo - 1693 votes, Podolsk - 1268 votes.

The online voting lasted ten days. All courtyard areas of the Moscow region took part in the voting, with the exception of courtyards that were already comprehensively landscaped from 2015 to 2017, and courtyards that were put into operation no later than 2013, as well as courtyards that include apartment buildings planned for resettlement in the next seven years, the press release explains.

After the final address list of courtyard areas that will be improved in 2018 is formed, it is planned to hold discussions with residents about the types of work that will take place directly in the courtyard areas. Based on the results of each meeting, acts of approval of types of work will be drawn up with the obligatory signature of a representative of the public and residents. A diagram of the yard indicating the location of the elements to be landscaped and the types of planned work will be attached to the act. Then 130 courtyards that received the largest number of votes from residents were additionally included in the comprehensive improvement program in 2017.

Step 1. Find out the terms of the program

Local governments must develop and publish by April 1, 2017 draft municipal program for improvement of local areas. It specifies the conditions for participation in the program, the minimum list of works and examples of landscaping elements, and the cost of these elements.

  • attract sponsors.

Step 2. Make a plan

An initiative group is assembled from interested parties. It is important to consider whose property the yard is. It may belong to:

  • owners of one apartment building (included in common property);
  • owners of several apartment buildings (on land plots of two or more apartment buildings);
  • municipality;
  • owners of several apartment buildings and the municipality (a municipal plot is located between the land plots of apartment buildings).

To find out, you need to find out land boundaries, if they are defined. Information about the boundaries of a land plot can be found in the cadastral passport of the building or on the Rosreestr website.

No matter who owns the yard, it is possible to arrange it according to the program.

If the yard is common to several houses, then the initiative group should include representatives of each house. The initiative group solves the following tasks:

  • create a yard plan,
  • determine the list of works and the scope of participation of residents,
  • conduct OSS,
  • control the implementation of ideas at all stages.

Works to help residents in every municipality public commission. It brings together experts in landscaping, construction, and local history. Specialists will help you draw the yard and take into account:

  • wishes of the owners,
  • municipal program
  • natural and other features of the territory.

Step 3. Conduct OSS

With the finished drawing, the initiative group goes to the general meeting of owners. If the initiative group includes representatives of several MKDs, the OSS is held in each house with the same agenda.

  • elect the chairman and secretary of the OSS, the counting commission;
  • contact the compulsory health insurance with a proposal to include the yard area in municipal program for creating a comfortable urban environment for 2017 (in this paragraph you should indicate the planned list of works, which corresponds to the established minimum and additional lists);
  • determine the form and share of participation of the owners (the amount of financial participation is indicated as a percentage of the cost, labor participation - in the number of people involved in the work);
  • determine the procedure and source of financing for the work;
  • select the person responsible for the approval of the design project, control and acceptance of work;
  • include the installed objects into the general property of the apartment building for their subsequent maintenance.

Residents will have 1-2 months from the date of publication of the municipal program to prepare and hold a general meeting. And you need to prepare well for such a meeting. After all, if in at least one of several houses OSS solution will not be accepted, the yard will not be included in the program.

The Ministry of Construction of the Russian Federation recommends choosing an in-person form and holding the in-person part of the meeting in all courtyards at the same time. This way, residents will be able to discuss issues together and come to an agreement. All issues on the agenda must be resolved at the meeting.

Step 4. Submit an application

To include a yard in the program, local authorities are sent OSS protocol(one or several depending on the number of apartment buildings to which the yard area belongs) with the decisions made. A landscaping plan can be attached to the protocol.

A public commission will consider the application. It includes representatives of compulsory health insurance, political parties, public organizations, and so on. The review procedure must be published on the municipality’s website before April 1, 2017.

Municipal program project submitted for public discussion. There the fate of each application will be decided. Residents can take part in the discussion. How to do this is determined by the municipality.

Step 5. Agree on the design project

If the yard is included in the territory development plan, based on the plan (drawing) a design project. It may look different, depending on the amount of work planned. If necessary, it may contain design and estimate documentation or only images of the yard with a description of the proposed work and activities.

The design project must not violate the rights of third parties or interfere with the passage of utility lines. It will be approved by the responsible person selected at the OSS.

By July 1, 2017, municipal authorities must approve the design project for the yard. This will happen if:

  • authorized on behalf of the OSS, agreed on the project;
  • the owners have fully contributed their share of financial participation to a special account and/or submitted a letter of guarantee that specific named residents will participate in the work.

Once the design project is approved, the competitive selection of contractors will begin. They will begin to develop the territory approximately 1.5 months after the announcement of the competition.

Step 6. Controlling the work

An authorized representative of the owners supervises the improvement work. If he sees that contractors are doing work of poor quality or not in accordance with the project, he writes an appeal to the compulsory medical insurance.

When arranging the territory, workers must comply with accessibility requirements for people with limited mobility.

The plan for the yard must be completed by the end of 2017. The work is accepted by a commission, which includes the person in charge selected at the OSS. Experts can be hired to evaluate the work performed. If the activities are carried out efficiently and according to the project, an acceptance certificate is signed.

Step 7. Maintain the yard area

The improvement of courtyard areas is part of the large-scale state program “Formation of a comfortable urban environment.” The improvement of places where citizens spend a large amount of free time began in 2018 and should finally be completed by 2022. The essence of the program

Until recently, most of the courtyards in the cities and towns of Russia were in deplorable condition. Children's sports complexes and public gardens, preserved from the times of the Soviet Union, have long since fallen into disrepair and require reconstruction or complete replacement. The reason for this situation lies in the lack of funds for the installation and maintenance of modern facilities. Until 2018, yard improvement work was carried out exclusively at the expense of local budgets. As you know, the main expenditures of regional funds are spent on social needs, and practically nothing is left for improvement. The problem is especially acute in small municipalities. The government decided to correct the current situation by introducing a unique state program “Formation of a comfortable urban environment.”

According to the approved program, areas near residential buildings and public areas will be built according to new projects. The lion's share of all costs will be borne by the government and allocated money from the federal budget. Regional authorities are responsible for correctly distributing them among cities and regions. It is important to understand that municipalities will receive money from the state treasury only after the development and approval of their own improvement program.

The direct participation of citizens in choosing a project for a particular yard is the main feature of the state program. Residents of apartment buildings themselves have the right to decide how the area near their home will be equipped. Meanwhile, the law provides for two types of work: minimal and additional. The first includes a standard set of services:

  • installation of benches and trash cans;
  • repair of sidewalks within the yard;
  • equipment of a modern lighting system.

At the request of the users of courtyard areas, it is possible to carry out additional work within the framework of the program. For example,

  • equip playgrounds for children of different ages;
  • provide areas for adults to relax;
  • organize places for walking pets;
  • carry out landscaping of areas (planting hedges, installing small architectural forms);
  • allocate space and equip parking spaces for residents and guests.

Since courtyard space is limited, residents need to make their own choice between one solution or another.

Important. If they wish to carry out work from the additional list, citizens will need to make their contribution. You can participate in the improvement of your yard through financial subsidies, and you need to pay at least 5% of the cost of repairs. An option is allowed when residents invest labor resources instead of money. For example, they paint the site themselves or plant trees themselves. Financial participation does not always mean that citizens will have to pay money out of their own pockets. Previously paid and accumulated funds from the capital repair fund can be spent for these purposes.

How to become a participant in the program

The creation of a comfortable public space, equipped from a practical and aesthetic point of view, as part of an improvement program is possible only for residents of apartment buildings. It is legally determined that settlements with a population of more than 1,000 people can participate in the program. At the same time, only the yard where residents express their desire and submit an application will be included in the program. Consent to improvement under the “Formation of a Comfortable Urban Environment” program implies that residents are ready to co-finance the costs of developing the territory and further ensure its maintenance. The concept for landscaping the yard should be proposed by the municipality. And residents have the right to choose one direction or another at their own discretion.

In order to get into the federal program you must:

  • Get acquainted with the improvement plans for the desired period. This can be done on the official website "urban environment". Applications are generated in the current year for the next year. That is, in order for the work to be completed in 2020, you must submit an application before the end of 2019.
  • Contact the district authorities with a desire to join the program or simply complain about the mess in the yard. As practice shows, in response to an appeal, a letter will be sent with an official offer to take part in the federal project.
  • Organize a meeting of residents of those houses to which a specific territory belongs. By voting, citizens decide to participate in the program or not. If the decision is positive, it is necessary to select a group of people who can do organizational and “paper” work. Together, residents must decide on the amount of funding.
  • The initiative group is drawing up a sketch plan for the future vacation spot. In this case, it is important, if possible, to take into account all the wishes of the residents expressed at the first meeting. In the preliminary design, it is necessary to schematically outline the new yard, with existing objects and new ones planned for construction. Most often, residents turn to specialized companies to draw up a sketch. It would be good if the residents chose a responsible citizen who would agree to work on approving the project.

  • As the draft plan is being prepared, resident activists collect a complete package of documents to send to the administration. In addition to the diagram, it includes: an inventory passport of the yard, information about the collection of utilities, an estimate, and minutes of the meeting of the residents’ meeting.
  • If the project is approved by the commission, then the next step is to select a company that will perform the work. The competition to select a contractor is usually held by a management company. Most often they choose the company with the least amount for the work.
  • During the work, residents are advised to monitor their quality. If any defects are found, it is important to indicate them in the acceptance certificate for the work performed.

As a rule, the arrangement work requires no more than one month. In the future, residents need to maintain the new yard in order. “By the way, the production of all elements of children’s playgrounds, from bolts and rivets to rubberized shockproof coating and complex geometry of plastic forms of slides and swings, is located in the Moscow region,” the minister added.

According to the press service, the priority areas for the implementation of the program are the installation of such complexes in subsidized municipalities, science cities, closed administrative-territorial entities, former military towns, which were transferred to the ownership of municipalities from the Ministry of Defense of the Russian Federation.

According to the program, it is possible not only to pave the local area, but also to build sports and children's playgrounds on it, carry out lighting, landscaping, and other important processes.

After completing the work according to the program, as required by law, maintenance of courtyards and access roads to an apartment building can be carried out both by the residents themselves and by the management company or HOA that maintains the building itself.

Almost every year, at the end of the winter period, the pressing issue of repairing the access road to a residential building arises. The responsibility of the municipality to monitor city property, including roads, is determined by Federal Law No. 196 (Article 12, paragraph 2).

Such a collective appeal is drawn up in two copies, its receipt must be registered. Municipal authorities must consider the application within a month.

Quality requirements

There are approved standards regarding the quality of roads in the courtyards of apartment buildings. These standards even indicate the permissible width, depth, and length of potholes on the road in the yard. The width of the hole cannot exceed 60 cm, and the depth of 5 cm. More serious damage is dangerous for cars that will move on such a road surface.

Housing cooperative

Members of the housing construction cooperative at the general meeting also jointly decide all issues related to the improvement of the house and its territory.

Residents must decide how much money they can allocate for road repairs and how it will be carried out - on their own or with the help of contractors.

If apartment owners in housing cooperatives themselves carry out repair work to improve access roads and sidewalks, they must comply with the requirements of Articles 153, 154,158 of the Housing Code.

When a house is serviced by a management company, she is obliged to carry out repair work in the local area, because the owners of the apartments transfer her a certain amount on monthly payments for improvement.

Current and major repairs can be carried out in the local area:

  • The current one involves repair work aimed at eliminating damage and partially restoring the territory. It is usually performed once a year. Residents can decide for themselves (if the territory is in common property) what processes will be performed during routine repairs.

An application with a request to repair the local area, access roads and sidewalks in the yard is submitted to the management of the Management Company, which under the contract maintains the house. At least half of the apartment owners must sign such a statement.

It must be registered and provided with the number of incoming documents. One copy of such a petition is kept by the applicants:

  1. The letter indicates the name of the management company, information about the manager to whom the application is sent, information about the applicant, and his address.
  2. The reasons why repairs are required are indicated, and the technical condition of the yard, roads, and sidewalks is described.
  3. A set of works is listed that, in the opinion of residents, need to be performed for the high-quality improvement of the local area and the creation of safe conditions for its use.
  4. The application must be accompanied by an inspection and inspection report of the territory and an expert’s opinion.
  5. At the end there must be signatures of residents, in an amount of at least 50%.

If the management company is inactive

Residents of apartment buildings should not be indifferent to the territory of their residence. It can be landscaped and landscaped with high quality and at a modern level. IMPORTANT! If the Management Company receives funds for the maintenance and improvement of the building, it must fulfill its obligations and carry out repairs in full and without delay.

When the management company does not want to respond to the demands of residents and finds constant reasons for postponing yard repairs, its clients can first complain to the head of this organization.
